SUBSTITUTE TRUSTEE'S NOTICE OF SALE
WHEREAS, on January 27, 2025, by Deed of Trust of record in TD Book 191, Page 2061, Register's Office for Humphreys County, Tennessee, Wanda K. Claxton, unmarried, conveyed to Jason K. West, Trustee, the hereinafter described real property to secure the payment of a Promissory Note (the "Note") and other indebtedness as described in said Deed of Trust; and WHEREAS, Jason K. West resigned as Trustee under said Deed of Trust; and David M. Smythe was appointed as Substitute Trustee pursuant to a certain Appointment of Substitute Trustee of record in Record Book 5, Page 493, said Register's Office, Humphreys County, Tennessee; and WHEREAS, default in the payment of the indebtedness secured by said Deed of Trust has been made; and the entire balance of which having been declared due and payable in accordance with the terms of the Note and Deed of Trust, the owner and holder of said indebtedness, Pinnacle Bank ("Beneficiary"), has directed me, the undersigned, Substitute Trustee, to foreclose said Deed of Trust and to advertise and sell the real property in satisfaction of said debt and the cost of foreclosure, in accordance with the terms and provisions of the Note and Deed of Trust.
NOW, THEREFORE, by virtue of the authority vested in me by said Deed of Trust, I will on the 12th day of March, 2025, offer for sale and will sell the following described real property at the front entrance of the Humphreys County Courthouse, 100 Public Square, Waverly, Tennessee, 37185 at 10:00 a.m., to the last, highest, and best bidder for cash, in hand, and free from any marshalling of the property, the equity of redemption, any statutory or common law right of redemption, homestead, dower, marital share and all other exemptions of every kind, all of which were expressly waived by the terms of said Deed of Trust, subject to, however, such prior encumbrances and priority tax liens as may appear of record in said Register's Office.
The property herein to be foreclosed is described as follows:
Lying and being Land in the Third (3rd) Civil District of Humphreys County, State of Tennessee, and being more particularly described as follows:
LOT 25A: BEGINNING at an iron pin that is located 2,443 feet southeastwardly along the south margin of Fire Tower Road from the northwest corner of the Roy W. Talmo property, of record in Book 140, Page 1016, in the Register's Office of Humphreys County, Tennessee, and being 30 feet from the center and on the south margin of said road, and being the northeast corner of Lot Number 26; thence with the south margin of said road, South 75 degrees 50 minutes 40 seconds East 199.69 feet to an iron pin, being the northwest corner of Lot Number 25; thence leaving said road and with the west boundary of Lot Number 25, South 5 degrees 44 minutes 43 seconds East 1,068.45 feet to an iron pin, being the southwest corner of Lot Number 25 and being on the north boundary of the R. Talmo property; thence with the north boundary of the Talmo property, South 70 degrees 02 minutes 43 seconds West 437.17 feet an iron pin, being the southeast corner of Lot Number 26; thence with the east boundary of Lot Number 26, North 5 degrees 00 minute 00 second East 1,265.93 feet to the beginning, containing 8.06 acres, by survey of Henry D. Walp, Jr., R.L.S. #236, dated July 21, 1994.
Being the same property conveyed to Wanda K. Claxton, widowed by Special Warranty Deed from Bank of America, N.A. dated January 25, 2005 and of record in Warranty Deed Book 188, Page 167, in the Register's Office of Humphreys County, Tennessee.
This is improved property with a mailing and street address of 3095 North Hurricane Creek
Road, McEwen, Tennessee 37101 (Tax Map 058, Parcel 058.00).
The sale will be for cash and without warranty of any kind. The property is subject to any and all easements or restrictive covenants of record with the Register's Office, Humphreys County, Tennessee. Proceeds of the sale will be applied in accordance with the provisions of the Deed of Trust. If the highest bidder is unable to comply with the terms of the sale, undersigned reserves the right to sell the property to the next highest bidder able to comply or to re-advertise the sale if he so chooses. The undersigned also reserves the right to postpone the date and time of sale upon announcement at the time and place specified above.

Notice is hereby given that on the 21st day of February, 2025 Letters of Administration in respect to the Estate of ROY C. WHEELER, deceased, who died December 1, 2024, were issued to the Administratrix by the Chancery Court of Humphreys County, Tennessee.
All persons, resident and non-resident, having claims, matured or un-matured, against the estate are required to file the same with the Clerk of the above named Court on or before the earlier of the dates prescribed in (1) or (2). Otherwise their claims will forever be barred:
(1) (A) Four (4) months from the date of the first publication (or posting, as the case may be) of this Notice if the creditor received an actual copy of this Notice to Creditors at least sixty (60) days before date that is four (4) months from the date of the first publication (or posting); or
